General Terms and Conditions of Ruhr Guitars

1. scope of application and definitions
1.1 These General Terms and Conditions apply to all contracts for the delivery of
goods concluded between Ruhr Guitars, Torsten Schulz, Dorfstraße 12a, 45527 Hattingen, and
consumers.
1.2 A consumer is any natural person who concludes a legal transaction for purposes
which can predominantly be attributed neither to his commercial nor his independent
professional activity (§ 13 BGB).

2. conclusion of contract
2.1 The product descriptions presented in our online store, on our website or in other media
do not constitute a legally binding offer,
but a non-binding invitation to the
customer to submit an offer.
2.2 The customer can submit a binding offer to conclude a purchase contract
by telephone, email, via an online order form or by other means
.
2.3 The contract is concluded when we accept the customer’s offer within five
days by
– sending the customer an order confirmation in text form (e.g. by email),
– sending the goods to the customer or
– requesting payment from the customer.
2.4 If Ruhr Guitars does not accept the customer’s offer within this period, the
offer shall be deemed rejected.

3. right of withdrawal
3.1 Consumers are generally entitled to a right of withdrawal.
3.2 Details on the right of withdrawal can be found in the separate
withdrawal policy of Ruhr Guitars.

4. prices and terms of payment
4.1 The prices quoted are final prices. They include all price components
including any applicable taxes. Shipping costs are shown separately if they are incurred
.
4.2 The payment methods available to the customer are stated in the respective
offer or as part of the order processing.
4.3 If advance payment has been agreed, the purchase price is due for payment immediately after conclusion of the contract
.

5 Delivery and shipping conditions
5.1 Delivery shall be made to the delivery address specified by the customer. Unless otherwise stated in the
offer, dispatch shall take place at the latest within
five working days after receipt of payment.
5.2 In the case of consumers, the risk of accidental loss and accidental
deterioration of the goods shall not pass until the goods are handed over to the customer or a third party designated by
as authorized to receive the goods.
5.3 If delivery is delayed for reasons for which the customer is responsible, the
customer shall bear the reasonable additional costs incurred as a result.

6. retention of title
The goods remain the property of Ruhr
Guitars until the purchase price has been paid in full.

7. liability for defects (warranty)
7.1 The statutory warranty rights apply to consumers.
7.2 The warranty relates to the condition of the goods at the time of delivery
. Information on the condition of used goods is provided to the best of our knowledge and
conscience. Signs of wear and tear due to age and use do not constitute a
defect, provided that they are described in the offer or are usual for used goods.
7.3 Obvious transport damage should be reported immediately by the customer to the deliverer
and Ruhr Guitars notified. However, non-notification has no
effect on the statutory warranty rights.

8. liability
8.1 Ruhr Guitars is liable without limitation for damages resulting from injury to life,
body or health, which are based on an intentional or negligent
breach of duty.
8.2 Ruhr Guitars is liable for other damages only in case of intent or gross negligence.
In the case of simple negligence, Ruhr Guitars is only liable for breach of material
contractual obligations, whereby liability is limited to the foreseeable
damage typical for the contract.

9. applicable law
All legal relationships between Ruhr Guitars and the customer shall be governed by the
law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In the case of
consumers, this choice of law shall only apply insofar as it does not deprive the mandatory
protection of the law of the country in which the consumer has his habitual residence
.

10. place of jurisdiction
If the customer does not have a general place of jurisdiction in Germany or moves his
residence abroad after conclusion of the contract, the place of jurisdiction for all
disputes arising from the contractual relationship is the registered office of Ruhr Guitars.

11. alternative dispute resolution
11.1 The EU Commission provides a platform for online dispute resolution at
https://ec.europa.eu/consumers/odr
.
11.2 Ruhr Guitars is neither obliged nor willing to participate in a dispute resolution procedure
before a consumer arbitration board.
